These Terms of Use ("Terms") govern your access to and use of the Fillet Found mobile application and website (the "Service") operated by Fillet Found ("we", "us", or "our"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or 16 in the European Economic Area) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Description of Service
Fillet Found provides AI-assisted fish species identification, marine condition information, fishing zone exploration, vessel activity maps, recipe suggestions, and related features. The Service is provided for informational and educational purposes only.
3. Account Registration
Some features require an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of fishing regulations
- Upload content that is illegal, harmful, offensive, or infringes third-party rights
- Attempt to reverse engineer, scrape, or disrupt the Service
- Misrepresent AI identification results as official or legally binding species certification
- Use automated systems to access the Service without our permission
- Interfere with other users' enjoyment of the Service
5. AI Identification Disclaimer
Species identification, catch verification, marine forecasts, fishing scores, vessel data, and recipe suggestions are generated using artificial intelligence and third-party data sources. Results may be inaccurate, incomplete, or outdated. Fillet Found does not guarantee the accuracy of any identification or recommendation.
Always verify species identification, local fishing regulations, catch limits, seasons, and licensing requirements with official sources before taking any action based on information from the Service.
6. Location and Safety
Marine condition data, fishing scores, and safety insights are informational only. They are not a substitute for professional maritime advice, weather services, or personal judgment. You are solely responsible for your safety on the water.
7. User Content
By uploading photos or other content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and display that content solely to provide and improve the Service. You retain ownership of your content.
8. Intellectual Property
The Service, including its design, logos, text, graphics, and software, is owned by Fillet Found and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
9. Third-Party Services and Links
The Service integrates third-party data and services (including Global Fishing Watch, Open-Meteo, Google Maps, and recipe providers). We are not responsible for third-party content, accuracy, or availability. Your use of third-party services is subject to their respective terms.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FILLET FOUND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
12. Indemnification
You agree to indemnify and hold harmless Fillet Found from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.
13. Termination & Account Deletion
We may suspend or terminate your access to the Service at any time, with or without cause or notice. You may delete your account at any time from the app (Account → Delete Account) or via our Delete Account & Data page on the website. Account deletion is automatic and immediate — your profile, scan history, and associated data are removed right away, not after a waiting period.
Provisions that by their nature should survive termination will survive.
14. Changes to Terms
We may modify these Terms at any time. We will post updated Terms on this page with a revised "Last updated" date. Continued use after changes constitutes acceptance of the new Terms.
15. Governing Law
These Terms are governed by the laws of Australia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction in Australia, unless otherwise required by applicable consumer law.
